Welcome to the nitty gritty guts of it all. Maybe you clicked through looking for some light reading materials to put you to sleep (friends, please check out our ‘CHILL (the fuck out)’ range instead) or because you have a burning question you want answered. While this page looks long and boring, there is lots of juicy goodness here… and we have tried to keep it entertaining for you!

So, roll up, roll up, first things first, Salty Vibes owns and operates this website. These Terms apply to using the website, any product purchase or if you give us any shout out or product review. You agree to these Terms by using our website. If you do not agree to these Terms, please do not use this website.

 

1     WEBSITE

·       Ownership
Our website is important to us. The material on this website (including without limitation images, text and branding) is protected by copyright under the laws of Australia and the laws of other countries under international treaties. Do not copy, communicate, adapt, transfer or distribute any of the contents without our written permission first. No trade mark or logo on this website may be used in any way without prior written permission. It sounds serious, because it is. We mean it. Stealing IP is not on.

·       Promotions
Get excited! We might publish certain competitions, offers, programs or promotions on our website. We will set up a dedicated space for any applicable T&Cs so make sure you check those terms before entering or participating. We will sometimes add, remove, alter or amend competitions or promotions on our website as permitted by law, so do check back in.

·       Third party content
FYI friends, we may provide third party links or third-party content but it’s for your convenience and information only. We are not responsible for the content on third party websites linked to our page. We do not endorse any third-party content and recommend you check all third-party website terms before using any linked pages. Please be sensible, check first.

Use of this website is at your own risk. We cannot guarantee that any data or program available on this website (or any linked website) is free of viruses, spyware or other dangerous content. It is your responsibility to make sure you have the equipment and ability to access this website safely.

 

2     PURCHASE TERMS

·       Account registration
Seen something you like? To purchase our products you may decide to set up an account and be logged in using a valid email address. You are responsible for ensuring that your account details are accurate and up to date, and for keeping your account details and password confidential – we can’t keep track of that, so stay organised!

 

·       Orders
It’s easyyyy - you can place an order by following our website prompts. We accept orders from Australia at present, but hey – get in touch if you’re out in the big wide world and want to order, we can see what we can do. We reserve the right to accept or reject your order for any reason, including if the requested product is not available, there is an error in the price or product description on this website or an error in your order – but we will be sure to let you know as soon as possible. Each order that we accept results in a separate binding agreement between us for the supply of that product on these Terms.  

 

·       Payment
All prices are in Australian dollars and are inclusive of any applicable GST. We accept payment via debit or credit card (Visa or Mastercard), or any express checkout provider listed on checkout. You will be charged during the purchasing process and prior to delivery. If we are unable to charge your credit or debit card due to insufficient funds or other errors your order will be cancelled, and we’ll get in touch. We know, adulting is hard. 

 

·       Discount, Offers and Promo Codes

From time to time, we may offer discount codes, welcome offers, promotions, or special pricing (including but not limited to sitewide sales, bundles, subscription pricing, or promotional offers).

Unless expressly stated otherwise:

o   Discount codes (including welcome or first-order discounts) cannot be used in conjunction with any other offer, promotion, or reduced price

o   Discount codes do not apply to products that are already discounted, including sale items, bundles, subscription pricing, or promotional packs

o   Only one discount, offer, or promotion may be applied per order

Salty Vibes™ reserves the right to remove, cancel, or adjust any promotion, discount, or order where a discount has been applied incorrectly, including where multiple discounts have been used contrary to these Terms.

·       Delivery 

o   We will deliver products via Australia Post or another carrier to the Australian delivery address you have nominated in your order.

o   Once your order is dispatched, it is not possible to change your nominated delivery address.

o   You will receive a tracking number via email once your order has been dispatched. If you are not home to receive your order it will be taken to the nearest Post Office for safekeeping and you will need to collect it. Alternatively, if you have asked our delivery partner to provide you with unattended delivery, your order will be left in a suitable spot at your nominated delivery address.

o   Delivery times may vary depending on the carrier and delivery address. We recommend allowing at least 7 to 10  business days for delivery.

o   If delivery fees apply, they will be communicated to you before you place your order and must be paid at the same time and in the same manner as you pay for your order.

o   Risk in products passes to you on the date and time of delivery to the delivery address nominated in your order (including for unattended deliveries). You are responsible for the safe keeping of your order once it is left at your nominated address.

o   You promise and warrant that the person receiving products at your nominated delivery address is authorised by you to do so.

·       Changing or cancelling orders
Once you have placed an order it is not possible to change or cancel the order or your payment method, because of the timeframe in which your order is picked and packed for delivery. We’re faster than the speed of light, well, not actually, but it’s action stations over here!

·       Out of stocks and substitution
It’s rare, but if you place an order for a product that is out of stock or unavailable, we will endeavour to notify you as soon as possible and arrange either a refund or supply of a substitute product.  

·       Returns and refunds
Please choose carefully as we do not offer refunds or returns for change of mind, personal preference or incorrectly purchased products. Our products come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law and consumer guarantees.

·       Personal use only
You may only use this website for personal purposes unless we provide written consent otherwise. You are not permitted to purchase any of our products for resale to a third party for retail, wholesale or trade purposes without our prior written consent.

·       Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. For major failures with a good, you are entitled to choose a refund or replacement. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund of the price paid for the goods and to cancel any contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or service.

 

2      REVIEWS & CONTENT

·       Reviews
We want to hear what you think, but we also have a responsibility to keep this a safe space. Any materials or content you submit may be changed, condensed or deleted if we reasonably consider it to be in violation of content guidelines or any other provision of these Terms. We cannot guarantee that you will be able to edit or delete any material or content you have submitted, and you are solely responsible for the contents, so please carefully consider what you write or submit and be mindful of names, places and what you share. Ratings and written comments are generally posted in a timely manner, however we reserve the right to remove or refuse to post any submission including if we reasonably consider the post to be in breach of these Terms or other applicable content guidelines.

 

·       Materials and Content
By submitting any materials or content to us via this website or any product review service offered, you promise (representing and warranting) and agree that:

o   you are at least 18 years old;

o   the details you submit are true and correct, and not known by you to be false, inaccurate or misleading;

o   you are the sole owner and have all necessary rights, consents and licenses to submit and publicise the materials or content and grant the rights required by these Terms;

o   any submission by you will not be unlawful, defamatory, hateful, offensive, unlawfully threatening or harassing;

o   you were not compensated by any third party or granted any compensation or consideration; and

o   you will not include any third party contact details, phone numbers or personal information.

·       Licence
If you post any material or content on our website, you grant us and our agents, affiliates and assignees an irrevocable, perpetual, sublicensable, royalty-free, worldwide licence to use, adapt and modify that content without compensation, attribution or liability. You promise and warrant you have the full authority to grant these rights.

 

4    THE SUPER NITTY GRITTY

·       Privacy

We collect and use your personal information in accordance with Australian privacy laws. By submitting your personal information in connection with your account and/or order, you agree that we may use your personal information to contact you about your account/order or for other administrative purposes and for any other purpose permitted or required by law. We may also use your personal information (e.g. email address) to send you electronic marketing materials about our goods and services, which you can opt out of at any time.

 

·       Termination

We may stop making this website available without prior notice. If we cease operating the website, any orders already submitted by you and accepted by us will not be affected unless the relevant products are no longer available or we are prevented from supplying those products (in which case we will notify you and provide a full refund).

·       Warranties
We use best endeavours to ensure, but we do not warrant, that any information provided on the website is accurate, complete, reliable, current or error free. To the full extent permitted by law, and subject to your consumer guarantee rights under the Australian Consumer Law which cannot be excluded, you acknowledge that the website is provided “as is” and that no warranties, whether of merchantability, fitness for a particular purpose or otherwise, are made by us in relation to the products, this website or these Terms.

·       Liability
Without excluding, restricting or modifying any rights and remedies you may be entitled to under the consumer guarantee provisions of the Australian Consumer Law, you acknowledge and agree that we are not liable for any loss or damage (whether direct, indirect, special, punitive, incidental, consequential or otherwise) arising out of or in connection with these Terms in contract, tort, under statute or otherwise, unless such loss or damage is caused by our own negligence, wilful misconduct or fraud. Our liability to you for any loss or damage of any kind arising out of these Terms (whether in contract, tort (including negligence), under statute or otherwise) is reduced to the extent that you cause or contribute to the loss or damage.

 

·       Indemnity
You agree to indemnify and hold us harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown and including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law, these Terms or the rights of a third party in connection with your use of the website or any content that you submit to us, except to the extent that such claim, demand or damage is caused or contributed to by us.

 

·       Applicable law
We operate this website from Australia. The laws of South Australia govern these Terms. If any part of these Terms is found to be unenforceable, you agree that the rest remain in full force and effect.

 

·       Global notice
We make no representation that this website complies with any laws outside of Australia, even if you are accessing this page from another country.
